Latin American Film Center, Inc. (“LAFC”) knows that users of its website care about the personal information they provide to us. This privacy policy, which is part of our overall Terms and Conditions of Use, is designed to provide you with information about how we collect, store and use personally identifiable information obtained through the Site (as defined in our Terms and Conditions of Use). We refer to this information as “personal information.” LAFC reserves the right to revise this privacy policy from time to time, and by using the LAFC website, you are agreeing to the terms of the then-current privacy policy.

HOW INFORMATION IS COLLECTED

When you register for or wish to utilize certain of our Site services, we will ask you for information such as your name, address, e-mail address, telephone number, certain demographic information and (if needed) credit card information. We need certain information in order to register you as a unique user and let you access personalized services. However, other requested information is optional and can be given at your discretion.

Please remember that any information you share in public areas, such as message boards or feedback sections, becomes public, and therefore this Privacy Policy does not apply to any information you choose to make public. Please be careful about what you disclose, and do not post any personal information that you expect to keep private.

BLOGS

We welcome your participation on our blogs, once they become operational. An email address is required to post comments. We will not share these email addresses with any third parties for marketing purposes.

CHILDREN TWELVE AND UNDER

LAFC does not knowingly solicit personal information from children. Visitors twelve years of age and under should remember that they are required to obtain an adult's permission before submitting any personal information to this or any other website.

“COOKIES”

NON-PERSONAL INFORMATION

In addition, when you interact with the Site, our servers may keep an activity log that does not identify you individually (“Non-Personal Information”). Generally, we collect the following categories of Non-Personal Information:

  • We may collect certain demographic data such as age, gender, and five-digit zip code as part of collecting personal information;

  • We may collect and store certain device information about your computer, mobile device, or other device that you use to access the Site. This information may include IP address, geolocation information, unique device identifiers, browser type, browser language, and other transactional information;

  • We may automatically log certain usage information about your use of the Site. This information includes a reading history of the pages you view. We use this information to provide you with a more customized experience on the Site;

  • We may collect and store additional “traffic data” such as time of access, date of access, software crash reports, session identification number, access times, and referring website addresses; and

  • We may collect and store your search terms and search results.

We may also collect and store certain other information regarding our users’ use of the Site so that third parties may provide us with reports and analysis regarding usage and browsing patterns of the Site.

HOW WE COMBINE YOUR INFORMATION

We may combine information gathered from the Site and information that we have received, gathered, acquired, or stored from other sources, both information collected offline by LAFC and information received from third parties—including information that currently exists in our files—into a single customer or donor record. We also use and/or combine information that we collect offline or receive from third-party sources (e.g., contact information from government funders or grantor information) to edit, enhance, and/or check the accuracy of your customer or donor record.

USE OF INFORMATION WE COLLECT

Personal information collected through the Site may be used by LAFC to communicate with you about your transactions with us and sending you information about features of the Site or about LAFC, to register you as a user, allow purchasing and shipping of tickets, subscriptions, memberships and/or merchandise, management of donations, enable you to participate in special promotions and to navigate the Site without having to re-enter information, administer the Site, comply with applicable law, when you participate in surveys, panels or research, in conjunction with employment inquiries or applications by you, when you participate with social media accounts involving LAFC activities, when you participate in communities, chat rooms, and other interactive services, in conjunction with any verification of your account information, in conjunction with investigations into any activity that may violate the law or the Site’s Terms and Conditions of Use and as otherwise provided in this privacy policy.

We may occasionally make personal information available to select other organizations, including but not limited to, non-profit arts organizations, affiliated organizations, supporting foundations, agents working on our behalf, companies or organizations with whom we have a contractual or sponsor relationship, or in connection with an asset transfer. We may also provide aggregated data to these and other organizations. Although we may make reasonable inquiries to determine that such other organizations maintain website privacy policies comparable to ours, we are not responsible for the enforcement of such policies.

Certain of our programs use personal information to send updates and notices to registered users via e-mail. If you provide your mailing address or telephone number, LAFC may also use your personal information to contact you by mail or by telephone regarding special offers from LAFC, updated information about LAFC or Site, and new services offered by LAFC. If you wish to be removed from this contact list, you may do so by contacting LAFC directly. (See the “Whom To Contact If You Have Questions” section below).

HOW WE SHARE YOUR INFORMATION

LAFC adheres to the highest standards of ethical practices in all our operations and is dedicated to protecting the privacy of all visitors to the Site. Except as disclosed below, we don’t sell, barter, give away, rent, or permit anyone outside LAFC to use or access your personal information.

We occasionally use independent contractors and third-party agents, Affiliates, and partners to perform functions such as marketing, analytics, providing customer service, etc., on our behalf. These entities have access to the personal information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of any personal information collected from the Site. They are restricted from using, selling, distributing, or altering this data in any way other than to provide the requested services to LAFC.

We may also occasionally share your personal information with our organizational and funding partners, grantors or co-sponsors of our programs, activities, initiatives, and events from time to time. We endeavor to share your personal information only with partners, grantors and co-sponsors who will respect your personal information. Although our treatment of your personal information is governed by this Privacy Policy, our partner or co-sponsor’s treatment of your personal information will be governed by the partner or co-sponsor’s privacy policy. You may withdraw your consent to our sharing of your personal information with partners and co-sponsors at any time by following the opt-out process described below.

We may also use or disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us or the Site; (b) protect and defend our rights or property, the Site, or our users; and (c) act under emergency circumstances to protect the personal safety of us, our Affiliates, our agents, or the users of the Site or the public.

ONLINE MEMBERSHIPS AND DONATIONS

When you purchase a membership in LAFC or make a donation to LAFC online, we will ask you to provide us with the information we need to process your membership and/or to acknowledge your contribution. This information includes your name, billing and mailing addresses, telephone number, e-mail address, and credit card information. Your credit card information will be stored temporarily on a secured server and used only as needed to process your transaction. We will retain your personally identifiable information for our records, in order to facilitate better customer service and/or donation recordkeeping. To process payments for members who have selected automatic renewal, LAFC will also retain payment information, in a secure manner, until such time that either the payment information expires (when we will contact you to update it), or the auto-renewal of the membership is canceled by you. In certain cases, you may be asked for additional information to complete your request, such as the names and birth dates (month/year) of your children if obtaining a Family Membership or any Contributing Membership with children.

THIRD-PARTY SERVICE PROVIDERS

LAFC may engage reputable third-party vendors in order to help us manage the Site and allow us to better service our visitors and customers. These may include third-party vendors engaged to analyze, for marketing purposes, the information collected on the Site.

LAFC’s site may contain links to third-party websites. Once you leave the Site, this privacy policy will not apply to such websites.

ADMINISTRATION OF THE SITE / COMPLIANCE WITH LAW

We may disclose your personal information when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be violating our Terms and Conditions of Use or to protect the safety, property or other rights of our users or the public. In addition, we may disclose or access account information for administrative and other purposes that we believe are necessary to develop, maintain, and improve our products and services. We also may disclose your personal information if we believe in good faith that we are required to do so in order to comply with applicable law, a subpoena, or other legal process.

SECURITY USED TO PROTECT YOUR INFORMATION

We take commercially reasonable steps, either directly or through third-party providers, to maintain the security of customer information via a variety of access controls, including password protection, electronic firewalls, and data encryption. However, LAFC does not guarantee the security of such information.

It is important for you to protect yourself against unauthorized access to your password and to your computer.  Be sure to use a known and trusted secure connection and to log off when finished using a shared computer. Notwithstanding our commitments to protect your information (including Personally Identifiable Information) from loss, misuse or alteration by third parties, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. As a result, while we strive to protect your information, we cannot ensure or warrant the security and privacy of any information you transmit to us, and you do so at your own risk.

OTHER ORGANIZATIONS FEATURED ON THE SITE

We may provide links to other websites, but LAFC is not responsible for the privacy policies, terms and conditions of use, or content of any such websites. We encourage you to familiarize yourself with the privacy policies and terms and conditions of use of linked websites. You may agree to provide personal information to other companies who provide content for various parts of the Site. If you agree to provide information to such companies, that information will be subject to their privacy policies.

OPT-OUT PROCESS

You have a right at any time to stop us from contacting you for marketing purposes. When you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the promotional e-mail you receive or by contacting us directly at info@lafcnyc.org.  Despite your indicated e-mail marketing preferences, we may still send you relationship and/or transactional e-mails regarding the Site or our services, including, for example, administrative confirmations and notices of updates to our Privacy Policy, if we choose to provide such notices to you in this manner.

If you access the Site through a mobile device and you do not want your device to provide us with location-tracking information, do not agree to allow your device to share this information with us or disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. Your device manufacturer should provide instructions on how to disable GPS or other location-tracking functions.  If you initially consent to the collection of location information, you can subsequently stop our collection of location information at any time by changing the preferences on your mobile device or by uninstalling the application from your mobile device by following the standard uninstall process to remove applications from your device.
